Mac clone maker Psystar loses case against Apple

Neowin reports Psystar, the company that sells "Hackintosh" systems, has lost its lawsuit against Apple in the Appeals Court:

The US Court of Appeals has ruled, however, that the product violates Mac OS X copyrights and will not be allowed to be sold.

Apple's struggle against Psystar dates back to 2008, when the manufacturer came onto the scene in April of that year. It didn't take long for Apple to respond, and in July the company took Psystar to court for copyright violation, as well as breaking the infamous Digital Millennium Copyright Act.

In December 2009, the courts ruled in Apple's favour and granted them a permanent injunction against Psystar. The court's reasoning was that Psystar "violated Apple's exclusive reproduction right, distribution right, and right to create derivative works."

Fired HP CEO walks away with $13 million

BusinessWeek reports former HP CEO Leo Apotheker leaves the company with a golden handshake worth more than $13 million in cash and stock. Quite a nice bonus for a guy under whose 11-month reign HP's market cap plunged by nearly $40 billion.

Apotheker's parting package includes a $7.2 million severance payment and a $2.4 million bonus for his performance while he was CEO. He also will keep restricted stock currently worth about $3.7 million. The value of Apotheker's other stock awards will depend on how the company fares in the next few years, according to documents filed Thursday.

Hewlett-Packard Co. also will cover Apotheker's expenses for an anticipated move to France or Belgium.

Amazon to take over Palm?

VentureBeat received word that HP is currently looking to rid itself of Palm as soon as possible and that among a couple of contenders, Amazon is closest to acquiring the assets.

The Kindle Fire is powered by Android, but it�s been heavily customized by Amazon to the point where you can barely tell. By purchasing the remnants of Palm, Amazon would have free rein to redesign webOS to its own liking, and it would be able to further differentiate its Kindle devices from the slew of Android tablets in the market.

And even though HP has given up entirely on its webOS hardware business after the TouchPad tablet failed spectacularly, there�s still plenty of potential for webOS to power a successful device. Palm�s mobile software was praised for its slick multi-tasking capabilities, which could allow future Kindle Fire tablets to juggle games, movies and media with more finesse than Android.

Amazon to reveal 10.1-inch tablet before year-end

DigiTimes writes Amazon is likely to outsource the production of its upcoming 10.1-inch tablet to Foxconn and that shipments are likely to begin before year-end. The site also heard that Quanta landed the 7-inch Kindle Fire orders because Foxconn was too busy with manufacturing Apple's iPads.

Amazon is expected to outsource the production of 10.1-inch tablet PCs to Foxconn Electronics (Hon Hai Precision Industry), and shipments of the 10.1-inch tablets are likely to begin before year-end 2011 for holiday-season demand, according to industry sources. Foxconn declined to comment on market reports.

Foxconn has been a long-term contractor for Amazon's Kindle e-book readers, and market watchers had expected the company to also land orders for 7-inch Kindle Fire tablets.

Kaspersky Labs news service Threatpost reveals how the Kelihos botnet was taken down, you can read it over here.

Earlier this week, Microsoft released aTillmann Wernern announcement about the disruption of a dangerous botnet that was responsible for spam messages, theft of sensitive financial information, pump-and-dump stock scams and distributed denial-of-service attacks.

Kaspersky Lab played a critical role in this botnet takedown initiative, leading the way to reverse-engineer the bot malware, crack the communication protocol and develop tools to attack the peer-to-peer infrastructure. We worked closely with Microsoft�s Digital Crimes Unit (DCU), sharing the relevant information and providing them with access to our live botnet tracking system.
